Terms of Service Soceth / Locatch

Non-binding summary: Locatch is a location-based social and events platform for adults. You are responsible for your conduct, content, and safety. Soceth provides the Service “as is” and does not guarantee user behavior, real-world outcomes, or location accuracy. The terms below are legally controlling.
1) Parties and acceptance
These Terms of Service (“Terms”) form a legal agreement between you (“you”, “User”) and Soceth (“Soceth”, “we”, “us”) and govern your access to and use of the Locatch mobile application, our websites, and any related services (collectively, the “Service”).
By creating an account, accessing, or using the Service, you confirm you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
2) Eligibility (18+ only)
Locatch is strictly for adults aged 18 and older. By using the Service, you represent and warrant that you are at least 18 years old. If we suspect or determine that you are under 18, we may suspend or terminate your account immediately.
3) Related policies
Your use of the Service is also subject to our Privacy Policy and our Community Guidelines. If you violate those policies, we may take enforcement action under these Terms.
4) Account, security, and your responsibility
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate information and keep your account details reasonably up to date.
- You may not share accounts, use another person’s account, or impersonate others.
- You must comply with all applicable laws and regulations while using the Service.
5) User content and permissions
“User Content” includes any text, images, photos, videos, messages, event details, locations, comments, or other material you submit, upload, or share through the Service. You retain ownership of your User Content, but you are solely responsible for it.
License to operate the Service
You grant Soceth a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, and otherwise use your User Content only as necessary to provide, maintain, secure, and improve the Service, enforce these Terms, and comply with legal obligations.
Rights and legality
- You represent and warrant that you own your User Content or have all necessary rights and permissions to upload and share it.
- You must not upload content that infringes copyrights, trademarks, privacy rights, or any other rights of third parties.
6) Prohibited conduct (including zero-tolerance areas)
You agree not to do any of the following:
- Harass, threaten, bully, stalk, or encourage violence against any person.
- Post hate speech or discrimination based on protected characteristics.
- Share nudity, pornography, sexually explicit content, or non-consensual intimate imagery.
- Share content involving minors in any sexual, suggestive, exploitative, or abusive context. We have zero tolerance for child sexual abuse material (CSAM).
- Promote illegal activity (including drugs, weapons, trafficking, or instructions for wrongdoing).
- Run scams, phishing, spam, deceptive schemes, or request money/bank details/sensitive information from other users.
- Create fake accounts, impersonate, or misrepresent your identity.
- Attempt to reverse engineer, disrupt, scrape, overload, or bypass security/access controls.
- Use the Service for commercial solicitation or advertising without our written permission.
7) Safety and real-world interactions
Important: Locatch is a platform. We do not control or guarantee how users behave online or offline. You are solely responsible for your decisions, interactions, and safety.
- No background checks. Soceth does not conduct criminal background checks or verify identity by default.
- Meetups at your own risk. Events and meetups involve real-world risk. Use caution and common sense.
- Not an emergency service. Do not rely on Locatch for emergency response. If you are in danger, contact local emergency services.
User-to-user disputes
Any dispute, claim, or incident between users (including at events or meetups) is primarily between those users. To the maximum extent permitted by law, Soceth is not responsible for user conduct or outcomes of user interactions.
8) Location features disclaimer
The Service may use approximate or precise location (with your permission) to show nearby events or users. Location data may be inaccurate, delayed, spoofed, or unreliable due to device settings, network conditions, GPS limitations, or user manipulation. Soceth does not guarantee location accuracy and is not responsible for consequences arising from inaccurate location data or misuse.
9) Moderation, reporting, and enforcement
We may (but are not obligated to) monitor, review, remove, restrict, or disable access to any content or account for any reason, including suspected violations of these Terms, the Community Guidelines, safety concerns, or legal compliance.
- We may issue warnings, remove content, limit features, suspend accounts, or permanently ban users.
- We may preserve or disclose information if required by law or to protect rights, safety, or prevent abuse.

10) Third-party services
The Service may integrate third-party services (e.g., hosting, databases, maps, notifications, analytics, login providers). Soceth is not responsible for third-party services, their availability, or their actions. Your use of third-party services may be subject to their terms.
11) Intellectual property
The Service (including software, design, trademarks, and logos) is owned by Soceth or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted.
12) Service availability; changes
We may change, suspend, or discontinue any part of the Service at any time. We do not guarantee uninterrupted or error-free operation. Features may vary by region, device, or account status.
13) Termination
- You may stop using the Service at any time and may be able to delete your account within the app (where available).
- We may suspend or terminate your access if we believe you violated these Terms, created risk, or for legal/safety reasons.
- Upon termination, your right to use the Service ends immediately.
14) Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCETH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
SOCETH DOES NOT GUARANTEE RESULTS, CONNECTIONS, FRIENDSHIPS, DATES, EVENT OUTCOMES, USER CONDUCT, OR SAFETY IN ONLINE OR OFFLINE INTERACTIONS.
15) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCETH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCETH’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SOCETH (IF ANY) IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS. IN SUCH CASES, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
16) Indemnification
You agree to defend, indemnify, and hold harmless Soceth and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, (d) your violation of any law or rights of a third party, or (e) your interactions with other users or participation in events.
17) Governing law; jurisdiction
Governing Law. These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles.
Jurisdiction. Unless mandatory law provides otherwise, courts in İstanbul (Central) shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
Informal resolution first. Before filing a formal claim, you agree to contact us at info@soceth.com and attempt to resolve the dispute informally.
18) Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
19) Assignment
You may not assign these Terms without our prior written consent. Soceth may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
20) Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Service after the effective date means you accept the updated Terms.
